CronySoft NVR — Terms & Conditions

These Terms govern your use of the CronySoft NVR product and the CronySoft cloud service (collectively, the "Service"), provided by CronySoft ("we," "us," "our"). By installing the hardware, signing in to the cloud portal, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CronySoft sells and delivers a customer-premises network video recorder ("NVR") and provides a related online portal at app.cronynvr.com. The NVR captures and stores video locally at your site; the portal lets authorised users review live and recorded video, manage cameras, and download clips.

2. Hardware and warranty

  1. Each NVR is delivered with a limited hardware warranty for the period stated on the sales receipt or sticker affixed to the unit. The warranty covers manufacturing defects on the components we supplied — typically 12 months on the chassis and main board, and the manufacturer's stated warranty on storage drives (which can range from 12 months for consumer disks to 60 months for enterprise NAS drives).
  2. Warranty does not cover: physical damage, water damage, power surges, lightning strikes, tampering, unauthorised modification, third-party software installed by the customer, consumable wear (e.g. fan bearings, SSD endurance exceeded), damage caused by inadequate ventilation or cooling, or any cause outside CronySoft's reasonable control.
  3. Hard drives, SSDs, and any other storage media are mechanical / electronic devices that will eventually fail. We use reputable brands and recommended-grade media but neither CronySoft nor the drive manufacturer can guarantee any specific lifespan. A drive failure can occur at any time — including on day one.
  4. Within the warranty window we will, at our option, repair or replace the defective part. The customer is responsible for making the unit available for service (shipping or on-site access). Replacement parts may be new or refurbished and become the customer's property; the replaced part becomes ours.

3. Recordings, data loss, and data recovery

  1. You own your recordings. CronySoft does not claim ownership of video captured by your cameras.
  2. Recordings are stored locally on the NVR's drive(s). Cloud backup is an optional paid feature; in its absence, no copy of your footage exists anywhere except on your NVR.
  3. CronySoft is NOT responsible for lost footage, regardless of cause. This includes (without limitation) loss due to: drive failure, firmware failure, file-system corruption, power loss, accidental deletion, theft of the NVR, fire, water, lightning, malware, tampering, software defect, configuration change made by you or a person you authorised, or end of the retention window you configured.
  4. We strongly recommend you (a) configure a retention window that meets your operational and legal needs, (b) download evidentiary clips immediately when an incident occurs rather than relying on the in-NVR archive, and (c) subscribe to the optional cloud backup tier if continuity of recordings is critical to your business.
  5. If a drive fails and you wish to attempt data recovery, that is a separate paid service. Recovery is performed by third-party specialists; CronySoft does not perform recovery in-house and does not guarantee a successful outcome. The customer pays for the recovery attempt whether or not data is recovered, plus shipping to and from the recovery lab. We will quote an estimate before work begins.
  6. Replacement of a failed drive at the customer's request — either by the customer or by a CronySoft technician — does not include any data-recovery service. Any data on the failed drive may be permanently lost when the drive is replaced; if recovery is desired, the drive must be set aside before a replacement is fitted.

4. Customer responsibilities

  • Provide stable power (a UPS is strongly recommended) and reasonable environmental conditions for the NVR.
  • Maintain working internet connectivity if you wish to use the cloud portal or remote access features.
  • Keep account credentials confidential and use a strong unique password. Enable two-factor authentication on any account with administrative access.
  • Comply with all applicable laws regarding video surveillance, including notice requirements, employee monitoring restrictions, and recording in public or private spaces, in your jurisdiction. You — not CronySoft — are the operator of the surveillance system.
  • Do not use the Service to harass, stalk, or unlawfully monitor any person.

5. Subscription, billing, and cancellation

Some features (cloud backup, AI loss prevention, extended retention) require a paid subscription. Subscriptions auto-renew until cancelled. Cancellation takes effect at the end of the then- current billing period; pre-paid amounts are non-refundable except where required by law. Pricing may change with at least 30 days' notice.

6. Service availability

We aim for high availability of the cloud portal but do not guarantee uninterrupted service. Planned maintenance, internet outages at your site, ISP issues, third-party provider outages (SMS gateways, email delivery, payment processors), and force majeure events may all interrupt access. The NVR continues to record locally during cloud outages; remote access is what's affected.

7. Liability cap

To the maximum extent permitted by law:

  • CronySoft's total aggregate liability arising out of or related to the Service is limited to the amount the customer paid us for the Service in the 12 months immediately preceding the event giving rise to the claim.
  • CronySoft is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, loss of business, loss of recordings, loss of goodwill, or business interruption — even if advised of the possibility.
  • The Service is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, except as expressly stated in these Terms. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to defend, indemnify, and hold harmless CronySoft, its officers, employees and agents from any claim or demand — including reasonable attorneys' fees — arising out of (a) your use of the Service in violation of these Terms, (b) your violation of any law or any third-party right (including privacy and surveillance laws), or (c) any recordings you make using the Service.

9. Termination

Either party may terminate at any time. We may suspend or terminate immediately on notice if you breach these Terms, misuse the Service, fail to pay, or use the Service unlawfully. Sections 2–4, 7–8, and 10–11 survive termination.

10. Changes to the Terms

We may update these Terms from time to time. Material changes will be announced via the portal and/or by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which CronySoft is incorporated, without regard to conflict-of- law rules. Any dispute will be resolved exclusively in the courts of that jurisdiction, except where required otherwise by consumer-protection law applicable to you.
